These Terms and Conditions ("Terms") apply to your use of www.xploregifts.co.uk (the "Site") and to any order you place with us. The Site is operated by Xplore UK Distribution LTD, trading as Xplore Gifts, a company registered in England and Wales, of 30–32 Albion Road, Sileby, Loughborough, LE12 7RA, United Kingdom ("we", "us", "our"). By using the Site or placing an order, you agree to these Terms. If you do not agree, please do not use the Site.
1. Use of Our Website
This website is provided for general informational purposes, including information about our brand portfolio, services, and how to get in touch with us. You may use the website only for lawful purposes and in accordance with these Terms.
You must not:
- Use the website in any way that breaches applicable laws or regulations.
- Attempt to gain unauthorised access to any part of the website, its server, or other systems connected to it.
- Use the website to transmit, distribute or upload any harmful software (e.g., viruses, spyware).
- Use the website in a manner that disrupts its performance or functionality for others.
We reserve the right to suspend or restrict access to the site if you breach these Terms or we believe it necessary to protect our business, website, or users.
2. Placing an Order
When you place an order, you are making an offer to buy. A contract is only formed once we send you an order confirmation email — until then, we may decline or cancel an order (for example, if an item is out of stock, there's a pricing or listing error, or we suspect fraud), in which case we'll notify you and refund any payment already taken.
3. Pricing and Payment
All prices are shown in GBP and include UK VAT where applicable. We take reasonable care to ensure prices are correct, but if we discover a pricing error on an order you've placed, we'll contact you to confirm whether you'd like to proceed at the correct price or cancel. Payment is taken via Shopify Payments (and any wallet options offered at checkout, such as Shop Pay, Apple Pay, or Google Pay) at the time of order.
4. Delivery
We currently deliver to addresses within the United Kingdom only. Delivery methods, costs, and estimated timeframes are set out in our Shipping Policy. Delivery times are estimates, not guarantees.
5. Your Right to Cancel
If you are a consumer, under the Consumer Contracts Regulations 2013 you have the right to cancel your order within 14 days of receiving your goods, without giving a reason. To cancel, contact us using the details in Section 12. You must then return the goods to us within 14 days of telling us you wish to cancel, at your own cost, in their original condition where possible. Once we receive the returned goods, we will refund you within 14 days, including standard delivery charges (if any were paid).
This cancellation right does not affect your separate rights for faulty or misdescribed goods (Section 6).
6. Faulty, Damaged, or Incorrect Items
If an item arrives faulty, damaged, or not as described, you have rights under the Consumer Rights Act 2015, including:
- The right to reject the item for a full refund within 30 days of delivery; or
- After 30 days, the right to a repair or replacement, and if that isn't possible or doesn't fix the problem, a refund or price reduction.
Contact us as soon as possible with your order number and details of the fault — we won't ask you to cover return postage for genuinely faulty, damaged, or incorrect items.
7. Age Restriction
You must be at least 18 years old to place an order on the Site, or place an order with the involvement of a parent or guardian.
8. Intellectual Property
All content, graphics, logos, branding, text, images, and other material on the website are owned or licensed by Xplore Gifts and are protected by UK and international intellectual property laws. You may view and print material from the website for personal, non-commercial use only.
You must not copy, reproduce, modify, or distribute any content from the website without our prior written consent. Any unauthorised use of our intellectual property may result in legal action.
